  4. LICENSE AGREEMENT

  7. Please read the Master End-User License Agreement below. If you do not
  8. agree to the terms of this agreement promptly return your distribution
  9. materials to the place you obtained them for a full refund or delete your
  10. trial package.

  13. END-USER LICENSE AGREEMENT
  14.  
  15. This End-User License Agreement ("EULA") is a legal agreement between you
  16. (either an individual or a single entity)("CUSTOMER") and Nofeel Software Team.
  17. ("LICENSEE") for the software product "Nofeel FTP Server", which include(s)
  18. computer software, "online" or electronic documentation, and may include
  19. associated media and printed materials ("SOFTWARE PRODUCT").
  20.  
  21. The LICENSEE has been granted the authority to sub-license the SOFTWARE to
  22. you the CUSTOMER by Nofeel Software Team ("LICENSOR"). The LICENSOR is an intended
  23. third-party beneficiary and retains the right to enforce the EULA on its
  24. own behalf.
  25.  
  26. By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree
  27. to be bound by the terms of this EULA. If you do not agree to the terms of
  28. this EULA, promptly return the entire unused SOFTWARE PRODUCT, including
  29. all subscription updates that you may have received as part of the SOFTWARE
  30. PRODUCT, to the place from which you obtained it for a full refund and/or
  31. delete all files related to your trial demonstration version of the
  32. SOFTWARE PRODUCT.

  35. SOFTWARE LICENSE AGREEMENT
  36.  
  37. This SOFTWARE PRODUCT is protected by copyright laws and international
  38. copyright treaties, as well as other intellectual property laws and
  39. treaties. The SOFTWARE PRODUCT is licensed, not sold. The SOFTWARE PRODUCT
  40. consists of product documentation, a server application identified here as
  41. "SERVER", and support files individually identified as "COMPONENT" and
  42. collectively referred to herein as "SOFTWARE".

  44. GRANT OF LICENSE. Nofeel Software Team. grants to you as an individual, a
  45. personal, non-exclusive, non-transferable license to install and execute a
  46. single instance of the SERVER on a single computer or on multiple computers
  47. provided that there is no chance of concurrently running two or more
  48. distinct instances of the SERVER simultaneously. You may install the
  49. SOFTWARE PRODUCT without the SERVER on multiple computers as long as this
  50. is solely for communicating with and administrating the SERVER.

  52. TRIAL and REGISTRATION. You are granted the right to use the SOFTWARE
  53. PRODUCT without registration solely for the purposes of evaluating the
  54. performance of the SOFTWARE PRODUCT for a period of no more than 30 days.
  55. If after that time continued use of the SOFTWARE PRODUCT is desired then
  56. the SOFTWARE PRODUCT must be registered with Nofeel Software Team. If you 
  57. are an entity Nofeel Software Team grants you the right to appoint an
  58. individual within your organization to use and administer the SOFTWARE
  59. subject to the same restrictions enforced on individual users.
  60.  
  61. COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT are
  62. owned by Nofeel Software Team, its suppliers, or component vendors. The SOFTWARE
  63. PRODUCT is protected by copyright laws and international treaty provisions.
  64. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted
  65. material except that you may make one copy of the SOFTWARE PRODUCT solely
  66. for backup or archival purposes and install the SOFTWARE PRODUCT on one or
  67. more computers as limited by and outlined in the grant of license above.
  68. You may not copy the printed materials accompanying the SOFTWARE PRODUCT.

  70. You may not reverse-engineer, decompile, or disassemble the SOFTWARE
  71. PRODUCT, except and only to the extent that such activity is expressly
  72. permitted by applicable law, notwithstanding this limitation.

  76. DISCLAIMER OF WARRANTY

  79. NO WARRANTIES. THE SOFTWARE PRODUCT IS PROVIDED "AS IS"
  80. WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT
  81. PERMITTED BY APPLICABLE LAW, NOFEEL SOFTWARE TEAM DISCLAIMS ALL
  82. WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT
  83. NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY
  84. AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY
  85. AGAINST INFRINGEMENT, WITH REGARD TO THE SOFTWARE
  86. PRODUCT. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL
  87. RIGHTS. YOU MAY HAVE OTHERS WHICH VARY FROM STATE TO STATE.

  89. CUSTOMER REMEDIES. NOFEEL SOFTWARE TEAM'S ENTIRE LIABILITY AND YOUR
  90. EXCLUSIVE REMEDY SHALL NOT EXCEED THE PRICE PAID FOR
  91. THE SOFTWARE. NO LIABILITY FOR CONSEQUENTIAL DAMAGES.
  92. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN
  93. NO EVENT SHALL NOFEEL SOFTWARE TEAM BE LIABLE FOR ANY DAMAGES
  94. WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR
  95. LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS
  96. OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS)
  97. ARISING OUT OF THE USE OF OR INABILITY TO USE THIS
  98. SOFTWARE PRODUCT, EVEN IF NOFEEL SOFTWARE TEAM HAS BEEN ADVISED OF
  99. THE POSSIBILITY OF SUCH DAMAGES.
